
Underage Drinking in South Carolina
In South Carolina, it is illegal to purchase, attempt to purchase, consume or possess an alcoholic beverage by anyone under the age of 21 - no exceptions.
If a police officer thinks there is probable cause to believe you are underage and have consumed alcohol, i.e. the smell of alcohol is on your breath and body, you can be arrested for underage drinking. However, you have the right to request a breathalyzer test to prove otherwise. If the officer fails to grant your request for a breathalyzer test, that could result in your case being dismissed at trial.
If you are convicted of underage drinking, it is a misdemeanor with numerous, long-term consequences, including -
- A fine of between $100 and $200
- Jail time of a maximum of thirty days
- Loss of LIFE scholarship for one year for subsequent convictions
- Adverse affect on your ability to get a job
You may also be required to complete an alcohol education program at your own expense.
It is also against the law to knowingly give false information regarding your age in order to purchase alcohol. The penalties are a fine of between $100 and $200, and/or up to 30 days in jail.
