
Marijuana Distribution or Trafficking
South Carolina has very stiff laws regarding marijuana distribution or “trafficking”. If you have any amount greater than ten pounds, you will be considered a trafficker and will be subject to felony penalties for marijuana sales / trafficking as listed below:
Between 10 and 100 lbs
First Offense
- $10,000 fine
- Mandatory minimum of 1 year in jail, and up to 10 years without possibility of probation or suspension
Second Offense
- $15,000 fine
- Mandatory minimum of 5 years in jail, and up to 20 years without possibility of probation or suspension
Third or Subsequent Offense
- $15,000 fine
- Mandatory 25 years in jail, without possibility of probation or suspension
Between 100 and 2,000 lbs
- $25,000 fine
- Mandatory minimum of 25 years in jail without possibility of probation or suspension
Between 2,000 and 10,000 lbs
- $50,000 fine
- Mandatory minimum of 25 years in jail without possibility of probation or suspension
Greater than 10,000 lbs
- $200,000 fine
- Mandatory minimum of 25 year in jail without possibility of probation or suspension
Trafficking to a minor within ½ mile of a playground, park or school
- $10,000 fine
- Up to 10 years in jail without possibility of probation or suspension
